This notice is also provided for the purposes of art. 13 of Legislative Decree no. 196/2003, the Code on the protection of personal data, and for the purposes of article 13 of EU Regulation no. 2016/679 (hereinafter GDPR), concerning the protection, processing and dissemination of the personal data of those who interact with the website. This notice is provided solely for the TOPPE.COM website and not for other websites that the user may consult via links contained therein. 3. The purpose of this document is to provide information about the ways, times and nature of the information that the data controllers must provide to users upon connecting to the pages of the TOPPE.COM website, regardless of the purposes of the connection itself, in accordance with Italian and European legislation. 4. 3 Place of data processing 1. The processing of the data covered by the GDPR takes place at the company's premises located at Via Cupa San Marco, 47 Santa Maria La Carità (NA) and is handled by technical personnel of the Office in charge of Processing. During occasional maintenance operations of the website, data processing may be carried out by any external appointees such as those of the hosting service. The web hosting provider, which is responsible for data processing, processing the data on behalf of the controller, is located within the European Economic Area and acts in compliance with European rules.
III COOKIES
1 Cookies 1. The TOPPE.COM website uses cookies to make the user's browsing experience easier and more intuitive: cookies are small text strings used to store certain information that may concern the user, their preferences or the device used to access the Internet (computer, tablet or smartphone) and are used mainly to adapt the operation of the site to the user's expectations, offering a more personalised browsing experience and storing choices made previously. 2. IV DATA PROCESSED
1 Method of data processing 1. The TOPPE.COM website uses log files in which information collected in an automated manner during users' visits is stored. The information collected is as follows: internet protocol (IP) address; type of browser and parameters of the device used to connect to the site; name of the internet service provider (ISP); date and time of visit; the visitor's web page of origin (referral) and of exit; possibly the number of clicks. 2. The above information is processed in automated form and collected exclusively in aggregate form in order to verify the correct functioning of the site, and for security reasons. This information will be processed on the basis of the legitimate interests of the controller. 3. For security purposes (anti-spam filters, firewall, virus detection), the automatically recorded data may possibly also include personal data such as the IP address, which could be used, in accordance with the laws in force on the matter, in order to block attempts to damage the site itself or to harm other users, or in any case harmful or criminal activities. Such data are never used for the identification or profiling of the user, but only for the purpose of protecting the site and its users; this information will be processed on the basis of the legitimate interests of the controller. 4. The website . allows the entry of reviews by purchasers. In this case the site automatically detects and records certain identifying data of the user, including the email address. V RIGHTS OF THE USER
Art. 13, para. 2 of EU Regulation 2016/679 lists the user's rights. 1. The TOPPE.COM website therefore intends to inform the user of the existence: of the data subject's right to ask the controller for access to the personal data (art. 15 EU Regulation), their updating (art. 7, para. 3, letter a) Legislative Decree 196/2003), rectification (art. 16 EU Regulation), integration (art. 7, para. 3, letter a) Legislative Decree 196/2003) or restriction of the processing concerning them (art. 18 EU Regulation) or to object, on legitimate grounds, to their processing (art. 21 EU Regulation), in addition to the right to data portability (art. 20 EU Regulation); of the right to request the erasure (art. 17 EU Regulation), the transformation into anonymous form or the blocking of data processed in breach of the law, including data whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed (art. 7, para. 3, letter b) Legislative Decree 196/2003); of the right to obtain confirmation that the operations of updating, rectification, integration of data, erasure, blocking of data, transformation have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in the case where such fulfilment proves impossible or involves the use of means manifestly disproportionate to the protected right (art. 7, para. 3, letter c) Legislative Decree 196/2003); 2. Requests may be addressed to the data controller, without formality or, alternatively, using the form provided by the Data Protection Authority (Garante per la Protezione dei Dati Personali), or by sending an email to the address: info@toppe.com 3. The TOPPE.COM website is also provided with an automatic system for the deletion of registration data by the same user who intends to remove them permanently through a specific command within their control panel 4. Where the processing is based on art. 6, paragraph 1, letter a) express consent to use or on art. 9, paragraph 2, letter a) express consent to the use of genetic, biometric or health-related data, revealing religious or philosophical beliefs or trade union membership, revealing racial or ethnic origin, or political opinions the user has the right to withdraw consent at any time without affecting the lawfulness of the processing based on the consent given before the withdrawal. 5. Likewise, in the event of a breach of the legislation, the user has the right to lodge a complaint with the Data Protection Authority (Garante per la Protezione dei Dati Personali), as the authority responsible for supervising processing in the Italian State. 6. VI TRANSFER OF DATA TO NON-EU COUNTRIES
1. This site may share some of the data collected with services located outside the area of the European Union. In particular with Google, Facebook and Microsoft (LinkedIn) through the social plugins and the Google Analytics service. The transfer is authorised and strictly regulated by article 45, paragraph 1 of EU Regulation 2016/679, so no further consent is required. The companies mentioned above guarantee their adherence to the Privacy Shield. 2. Data will never be transferred to third countries that do not comply with the conditions laid down in article 45 et seq. of the EU Regulation.
VII. SECURITY OF THE DATA PROVIDED
1. This site processes users' data in a lawful and fair manner, adopting appropriate security measures aimed at preventing unauthorised access, disclosure, modification or unauthorised destruction of the data. The processing is carried out by means of computer and/or telematic tools, with organisational methods and with logic strictly related to the purposes indicated. 2. In addition to the controller, in some cases, categories of appointees involved in the organisation of the site (administrative, sales, marketing, legal staff, system administrators) or external parties (such as third-party technical service providers, postal couriers, hosting providers, IT companies, communication agencies) may have access to the data.
